Deputies challenge the Navy’s powers in port security and protection – El Financiero

Federal opposition MPs presented to the Supreme Court of the Nation (SCJN) a measure that is unconstitutional to challenge the new organic law for the Mexican navy.

The new legislation, published on 14 October in the Official Journal of the Federation (DOF), gives new powers to the maritime institution in matters of port security and protection.

The Prime Minister of SCJN, Arturo Zaldívar, ordered that the matter be referred to one of the Ministers (without giving his name), who must decide within the next few days whether or not to accept the above-mentioned appeal.

In its application, presented on November 19, 169 lawmakers from opposition parties asked the Constitutional Court to declare Articles 2, 4, 29 and 38 of the law invalid.

With regard to Article 2, the deputies challenge Titles IV, V, VIII, IX, X and XI, which stipulate, inter alia, that the Navy will conduct maritime control of maritime traffic and protect it in the Mexican naval zones.

In addition, it provides the authority to protect strategic facilities in the country and where the Supreme Command orders it, alone or in coordination with other authorities, within their respective areas of competence.

At the same time, Article 29 indicates the creation of the Maritime Police Unit, which will take over the administrative control of the naval personnel commissioned by the National Guard.

According to deputies, this law is another step towards the militarization of the country.
